Kathi Vidal, serving as the Under Secretary of Commerce for Intellectual Property and leading the USPTO, reflected on the paradoxical aspect of NFTs. She identified them as both potential channels for originators to capitalize on their IP rights and as emerging barriers in the defense of their creative outputs.
Acknowledging the general perplexity regarding IP entitlements linked to NFTs and the juridical nature of smart contracts, the evaluation promoted initiatives focused on education and protecting consumers as alternatives to revising legislation.
While the evaluation stopped short of offering concrete directives on leveraging NFT or blockchain innovations for patent and trademark filings within the U.S., it did allude to ongoing inquiries into their future utilities.
Examining the broader economic scenery, the report took note of the persisting challenges within NFT marketplaces, including the mention of a 22% falloff in sales figures within a week’s timeframe and a downturn in the base valuations of premier NFT compilations, despite an upward trend in Ether value.
Nonetheless, the IP rights framework is said to effectively address NFT complexities, emphasizing the role of enforcement and education in leveraging digital innovation within the blockchain.
